A Comparative Study on NCSBN Model and KNA Draft Nursing Practice Act

Abstract

This study would compare and analyse the draft of the Nursing Act developed by the Korean Nurses Association (KNA) in 2004 and the Model Nursing Practice Act developed by the National Council of State Boards of Nursing (NCSBN). The objectives of this study are to show the Korean characteristics and its weakness to adopt the strength of foreign legislative model by comparing the foreign legislative model and the draft of the Nursing Act by the KNA. As a result of comparing two in terms of 11 legislative factors, the Korean draft revealed its weakness in quality control after licensing. There are two measures introduced to complement this. First, the introduction of license renewal system, solidification of duties, and diversification of publishment are presented as a legislative plan for quality constrol after licensing. Second, the development of self-regulation system of nursing professional group is suggested as a measure to insure the effectiveness of regulation. Therefore, it is necessary to strongly consider the way to encourage the formation of cooperative relationship with the government by adding the self-regulation system into the draft of the Nursing Act suggested by the Korean Nurses Association.
